1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Subscriber," "User," "you," or "your") and KB Networks IT Solutions ("KB Networks," "we," "us," or "our"), a duly registered business operating in Manapla, Negros Occidental, Philippines.
By accessing our website at www.kbnetworksph.com, logging in to the Customer Portal, applying for or using any KB Networks internet or network service, or otherwise interacting with our systems, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you may not use our Services. Use of the Services on behalf of a company, organization, or household constitutes your authority to bind that entity to these Terms.
2. Eligibility and Account Registration
To subscribe to or use KB Networks Services, you must:
- Be at least 18 years of age, or have a parent or guardian who co-signs your service agreement
- Provide accurate, current, and complete registration information
- Reside or operate within a KB Networks service coverage area
- Maintain only one account per physical service address unless otherwise agreed in writing
- Not create an account using false or fraudulent identity information
KB Networks reserves the right to refuse service or terminate accounts at its sole discretion for violation of these eligibility requirements.
3. User Responsibilities
As a subscriber and/or portal user, you are responsible for:
- Maintaining the confidentiality of your portal account credentials and not sharing them with unauthorized persons
- All activity that occurs under your account, whether or not authorized by you
- Promptly notifying KB Networks of any unauthorized use of your account or security breach at support@kbnetworksph.com
- Providing accurate billing and contact information and keeping it up to date
- Ensuring that network equipment provided by KB Networks (routers, access points) is used only at the registered installation address and is not tampered with or relocated without prior approval
- Complying with all applicable Philippine laws and regulations in your use of the internet service
- Paying your monthly subscription fee on or before the due date indicated on your invoice
4. Prohibited Activities
You may not use KB Networks Services for any activity that is illegal, harmful, or in violation of these Terms. Without limitation, the following are prohibited:
- Accessing, transmitting, or storing content that violates Philippine law, including but not limited to child sexual abuse material (CSAM), pirated content, or content that incites violence
- Using the service to send unsolicited bulk communications (spam) or conduct phishing attacks
- Attempting to gain unauthorized access to other networks, servers, or systems
- Using the service to launch denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
- Reverse engineering, tampering with, or circumventing KB Networks network equipment or systems
- Reselling, sharing, or redistributing your internet connection to third parties for commercial gain without a separate written agreement with KB Networks
- Using the service in a manner that unreasonably degrades network performance for other subscribers
- Circumventing bandwidth management policies or fair-use policies applied to your plan
- Using the service to send threatening, defamatory, or harassing communications
Violation of these prohibitions may result in immediate suspension or termination of your service and may be reported to law enforcement authorities.
5. Services Provided
KB Networks provides fixed wireless and fiber internet connectivity services to residential and commercial subscribers in Manapla, Cadiz City, Victorias City, and E.B. Magalona, Negros Occidental, Philippines. Services include:
- Fixed broadband internet access (speed and terms per your subscribed plan)
- Access to the KB Networks Customer Portal for invoice management, payment history, and support ticket submission
- Technical support via in-office visits, phone, and remote assistance
- Network equipment installation at the registered address
- Optional WiFi Vendo access services for commercial operators under separate agreement
Service specifications, speeds, and pricing are detailed in your service plan documents and may be updated by KB Networks with advance notice.
6. Billing, Payments, and Subscriptions
Billing cycle: Invoices are generated monthly and due on the date specified in your service agreement (default: 15th of each month).
Payment methods: KB Networks accepts cash, GCash, and bank transfer. Additional payment methods may be made available from time to time.
Late payments: Accounts with unpaid invoices past the due date are subject to service interruption. KB Networks reserves the right to apply reconnection fees for accounts disconnected due to non-payment.
Refunds: Subscription fees are non-refundable except where KB Networks is unable to provide service due to a fault on our side. Prorated credits may be applied at KB Networks' sole discretion.
Price changes: KB Networks may adjust subscription pricing with at least 30 days' advance written notice delivered via email, SMS, or portal notification. Continued use after the effective date constitutes acceptance of the new price.
Disputes: Billing disputes must be reported within 30 days of the invoice date by contacting support at support@kbnetworksph.com.
7. Service Availability and Interruptions
KB Networks strives to maintain a reliable, high-availability network. However, we do not guarantee uninterrupted service. Service may be temporarily unavailable due to:
- Scheduled maintenance (subscribers will be notified in advance where possible)
- Emergency repairs, infrastructure upgrades, or hardware failure
- Natural disasters, typhoons, flooding, or other force majeure events
- Power outages at tower sites or subscriber premises
- Third-party network or upstream provider outages
- Government-mandated service restrictions or emergencies
KB Networks is not liable for damages resulting from service interruptions outside our reasonable control. Service Level Agreement (SLA) terms, if applicable, are stated in your commercial or business service agreement.
8. Intellectual Property
All content on the KB Networks website and Customer Portal — including text, graphics, logos, icons, software, and user interface design — is the exclusive property of KB Networks IT Solutions or its licensors and is protected under applicable Philippine and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Services for their intended purpose. You may not:
- Copy, reproduce, or distribute KB Networks website content without written permission
- Use KB Networks trademarks, logos, or branding in any manner that implies affiliation or endorsement
- Scrape, crawl, or extract data from the portal or website using automated tools
- Reverse engineer or decompile any software used to deliver the Services
9. Limitation of Liability
To the maximum extent permitted by applicable Philippine law, KB Networks IT Solutions and its officers, employees, agents, and partners shall not be liable for:
- Loss of revenue, business, data, or profits arising from service interruptions
- Indirect, incidental, special, consequential, or punitive damages
- Damages arising from unauthorized access to your account or data caused by your failure to maintain account security
- Errors, inaccuracies, or omissions in content on our website
- Actions or content transmitted by third parties over our network
In no event shall KB Networks' total liability to you for any claim arising under these Terms exceed the total subscription fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.
10. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis. KB Networks makes no representations or warranties, express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the Services will be error-free, uninterrupted, or virus-free
- Warranties that internet speeds will consistently reach advertised maximums (actual speeds vary based on distance, congestion, equipment, and other factors)
- Warranties regarding the accuracy, completeness, or timeliness of content on our website
Nothing in this section limits our liability for death or personal injury caused by our negligence or for fraud.
11. Termination and Suspension
By KB Networks: We may suspend or terminate your service and/or portal access, with or without prior notice, for:
- Non-payment of subscription fees past the grace period
- Violation of these Terms or our Acceptable Use Policy
- Fraudulent or abusive behavior affecting our network or other subscribers
- Legal requirements or court orders
- Discontinuation of service in a coverage area
By you: You may cancel your subscription at any time by providing written notice to KB Networks at least 15 days before your next billing cycle. Early termination fees may apply if you are within a minimum contract period.
Effect of termination: Upon termination, you must return any KB Networks-owned equipment. Unreturned equipment fees may be charged. Your portal access will be disabled and your data handled in accordance with our Privacy Policy and Data Deletion Policy.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising out of or relating to these Terms or the Services shall first be submitted to good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to the appropriate courts of Negros Occidental, Philippines, which shall have exclusive jurisdiction.
Subscriber rights under applicable consumer protection laws (Republic Act No. 7394 — Consumer Act of the Philippines) are not waived by these Terms.
13. Changes to These Terms
KB Networks reserves the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Post a notice on the KB Networks website and customer portal
- Notify active subscribers via email or SMS at least 15 days before the changes take effect (for material changes affecting subscriber rights)
Your continued use of the Services after the effective date of updated Terms constitutes your acceptance. If you do not agree to the updated Terms, you must discontinue use and notify KB Networks in writing.
